International Divorce & Cross-Border Families

A family may have connections to several countries at once. Coordinate the questions of jurisdiction, applicable law, children, assets and enforcement before deciding where or how to proceed.

Jurisdiction and applicable law are different

The court able to hear a case and the law it applies are separate questions. Article 1 of the 2024 Personal Status Law addresses its scope and permitted reliance on another law; its jurisdiction provisions must also be considered. A foreign passport or overseas marriage certificate does not, by itself, answer every question about the appropriate forum.

Foreign judgments need a separate review

A divorce obtained abroad should be reviewed before relying on it for a UAE legal step. For enforcement in the UAE onshore courts, Article 222 of the Civil Procedure Code addresses conditions including jurisdiction, proper notification, finality and compatibility with UAE public order. Applicable treaties may affect the route. Recognition of marital status and enforcement of financial or child-related provisions should be assessed for their particular purpose.

Coordinate children and assets

List the countries where the family lives, assets are held and proceedings exist. Obtain advice before changing a child’s residence or taking steps affecting an overseas asset. Ask whether a proposed settlement or order will need further procedures in another country. Where foreign law is involved, advice from a lawyer in that jurisdiction may also be needed.

Prepare for your consultation

  • Nationalities, residence history, marriage certificate and details of any proceedings in another country.
  • Complete judgments, proof of finality and available records of service on the other party.
  • A country-by-country list of assets and the children’s residence and travel arrangements; check translation and authentication requirements before filing.

Common questions

Can I divorce in the UAE if I married abroad?

Potentially, but UAE jurisdiction and the relevant legal route must be established from your circumstances. The place of marriage alone does not decide eligibility.

Will a UAE order be effective abroad automatically?

Do not assume automatic effect. The receiving country’s recognition and enforcement rules, and any applicable treaty, need to be checked.
