Start with the purpose of the agreement

A marriage agreement, a temporary separation arrangement and a divorce settlement serve different purposes. Record the issues you want to address: property, payments, housing, debts, children’s routines or future disputes. The label on a document alone does not establish its legal effect.

Check the governing framework

The federal civil personal-status law recognises the relevance of agreed financial terms when determining post-divorce claims. Abu Dhabi’s Civil Family Court also provides marriage-agreement and post-divorce settlement procedures. These are specific routes, not a guarantee that any privately signed agreement is enforceable. Check the applicable law, required formalities and the position in any other country involved.

Draft for practical implementation

A useful draft identifies the parties, assets, amounts, due dates, responsibilities and how performance will be evidenced. Children’s arrangements should address everyday care, communication and travel while respecting the court’s role under the applicable law. Before signing, review whether approval, registration, authentication or another formal step is required; do not assume a private agreement itself dissolves a marriage.

Prepare for your consultation

  • The existing draft, marriage certificate and any previous agreement or court order.
  • A schedule of assets, liabilities and proposed payments with relevant supporting records.
  • Your priorities, unresolved questions and countries where the agreement may need to operate.

Common questions

Can an overseas prenuptial agreement be used in the UAE?

It needs individual review. Its wording, governing law, formalities and intended use in the UAE all matter.

Can parents settle every child-related issue privately?

Parents can propose arrangements, but should not assume their agreement removes the court’s powers or overrides the child’s interests under the applicable law.
