Which legal framework applies?
Federal Decree-Law No. 41 of 2024 is the general Personal Status Law. A separate civil framework under Federal Decree-Law No. 41 of 2022 and Cabinet Resolution No. 122 of 2023 applies to cases within its scope. Abu Dhabi also has a local civil-family regime. Nationality, religion, residence, the relevant court and permitted choice of law must be assessed together.
Agreed and contested divorce
An agreed approach requires clear terms and the appropriate formal process. If agreement is not possible, the legal requirements depend on the governing framework. Under Articles 7–8 of the federal civil law, either spouse can seek divorce without proving harm, after the other spouse is duly notified. Article 3 excludes those civil divorce proceedings from family-guidance referral. These rules should not be assumed to govern every divorce.
Plan beyond the divorce judgment
Ending the marriage does not answer every question about children, support or assets. Prepare a separate list of the arrangements you need, the issues already agreed and the matters still disputed. Does my spouse have to agree?
Not necessarily. The federal civil framework allows a unilateral divorce request. Other routes have their own conditions, so the governing law must be identified first.
How long will it take and what will it cost?
There is no single reliable figure for every case. Service of papers, disputed issues, translations, experts and appeals can affect timing and cost. Ask for an assessment based on your documents.
